APGA Files Motion to Intervene in Process Rule Challenge

On May 12, APGA filed a motion to intervene in the challenge of the Department of Energy’s (DOE) updated Process Rule. Several states such as California and Massachusetts, jurisdictions such as Washington, D.C., and public interest groups such as Natural Resources Defense Council and Sierra Club, challenged the updated Process Rule in the Ninth Circuit Court of Appeals last month.

APGA was significantly engaged in the rulemaking to update the Process Rule, as it impacts how DOE develops energy conservation standards and test procedures for gas-fired appliances. APGA was supportive of the final updated Process Rule and, therefore, felt it was important to engage in this proceeding.

APGA anticipates that other trade associations will also intervene in the case or otherwise engage in the proceeding. APGA staff will keep members updated as we learn more. McCarter & English staff assisted APGA with this filing.
