On June 14, 2016, APGA and the National Association of Home Builders sent a letter to Office of Management and Budget (OMB) addressing the Department of Energy’s (DOE) proposed final furnace rule which is currently being reviewed by OMB. OMB is responsible for reviewing and approving proposed and final rules. A copy of the letter is attached and will also be available on the APGA website. In the letter, APGA and NAHB express strong concerns that the “influential scientific information” upon which DOE is using as justification for the furnace rule not been properly peer-reviewed as required under OMB’s “Final Information Quality Bulletin for Peer Review” The “Final Information Quality Bulletin for Peer Review” requires each federal agency to conduct a peer review of all “influential scientific information” that the agency intends to disseminate. The data set forth in the Technical Support Document (TSD) upon which DOE relies in this proceeding is indisputably influential scientific information that DOE has disseminated. DOE was therefore required to subject the TSD and Spreadsheet as presently constituted to peer review and this failed to happen.#furnacerule #APGACorrespondence #NAHB
